Terms and Conditions

The tour begins when the participant gets off the plane finishes when the participant is taken back to the airport at the end of the tour. The participant agrees to release and hold harmless Travel Round America, its officers, shareholders, and employees, the exchange program and employees thereof, the school and chaperone from and not to sue such parties for any claims, demands, liabilities and causes of action participants may have arising out of action, or connected to, personal injury, death or property damage participants may suffer resulting from any cause what-so-ever, other than actual negligence of such persons. Without limiting the generality of the foregoing, the participant releases such persons from and agrees not to sue such persons for, any physical property damage which the participant may suffer from acts of God, strikes or government restrictions, terrorist activities, or for acts or omissions of persons or agencies not directly controlled by Travel Round America including without limitations, airlines, bus companies, cruise lines, railways, hotels, restaurants, attractions, shareholders and employees, the participant's school, the participant's exchange program and chaperone from any claims, demands, liabilities, causes of action and costs and expenses arising out of personal injury or damage that the participant either caused or contributed to, while participating on an Travel Round America program and from any financial obligations which the participant may incur on their own behalf. The participant understands that the air carrier's liability for loss or damage to baggage or property, or for death or injury to persons, is limited by their tarrifs, or the Warsaw Convention, or both. The participant understands and agrees that Travel Round Amerca shall not have responsibility to or for them when they are absent from Travel Round America's supervised activities.

The participant agrees to abide by Travel Round America's regulations and the directions of their chaperones and Travel Round America tour leaders during the tour. Failure to do so may result in Travel Round America terminating the participant from the tour immediately. The participant understands that termination from a tour due to failure to adhere to regulations and directions, will result in the participant being returned early to their host community at their own cost. Furthermore, the participant understands that their exchange program and natural parents will be advised of the infringement and agrees not to hold Travel Round America responsible for actions taken by their exchange program or parents.

All participants are forbidden to possess or use any non-prescription drug or alcohol, including beer and wine. The participant understands that a curfew will be enforced each night at which time they will be expected to be in their assigned room. The participant understands that to disobey such rules or directions is to waive their right to a refund of any part of the tour fee and that they will be returned to their host community at their own expense. The participant understands that Travel Round America reserves the right to make necessary changes in their iteneraries and departure dates and to use substitute airlines or equipment. In the event of changes being made, refunds will only be given in accordance with the provisions of Travel Round America's booking procedures. In the unlikely event that Travel Round America is unable to conduct a planned tour due to insufficient enrollment Travel Round America reserves the right to either transfer the participant to a similar tour, adjust the cost of the tour program or make a refund in full for payments made to Travel Round America.

This agreement constitutes the entire agreement between Travel Round America, the participant's exchange program and the participant, with reference to the subject matter referred to herein. The participant does not rely upon promises, inducements or agreements not herein, including but not limited to any oral statements made to them by any agents or employees of Travel Round America or by their exchange program. This agreement may only be ammended or modified in writing.

The terms and conditions set forth herein are governed by and are to be construed in accordance with the laws of the State of Washington. If any action at law or in equity including an action for declaratory relief, is brought to enforce or interpret any term or condition or to enforce any right and or legal remedy the other party might have against the other, such action must be brought in a State or Federal court in the State of Washington with a venue in the County of Pierce.
